Pediatric Care Nurse Expert Witness

By Flora Vinson

Many people do not know what a nurse expert witness does in a court case. Because the nursing profession depends on a code of conduct, which most jurors do not understand, they may need someone in the healthcare field to explain where the individual deviated from his or her standards of practice. This is why witnesses in various fields are allowed to share their knowledge.

Parents entrust their children to the care of pediatric hospitals and the nursing staff that help run them. These professionals are held to a high moral standard to do no harm. If they cause harm, it will be up to a jury to decide if it was on purpose or on accident and what should be their punishment.

The healthcare field is not a subjective practice. Although the nursing field is filled with many different types of professionals, they must all abide by the same underlying rule of do no harm. Any variation from this could have deadly consequences.

It is the job of the defense, and also the prosecution, to bewilder the jury. They may do this with medical terminology that the lawyers know the jurors have no idea what the terms mean. This is why the courts allow a professional with years of experience into the court; to explain what they know as facts along with their professional option.

Just as there are many different types of physicians, there are nurses that practice in different areas of the hospital. These different professionals would then be the ones who sign up to testify in court. They are the ones who use their vast knowledge and years of experience to help prove or disprove a case.

A pediatric care nurse expert witness is a paying job. This person could also work in a children's hospital or doctor's office to keep their skills current. They could also be a research assistant. Whatever they do, they would need to be certified and remain up-to-date on healthcare trends.
